Brazilian women above 50 to seek permission before assisted reproduction

– Reported, May 13, 2013

The president of the Brazilian Association of Assisted Reproduction, Adelino Amaral, who participated in drafting the rules of the CFM that, among other things, prohibits assisted reproduction for women with more than 50 years, asserts that the rule was adopted for respect the physiology woman, but there may be exceptions.

“A person over 50 who find themselves able to reproduce may petition the Regional Council of Medicine (CRM),” he explains. In this case, we will study the status of women who want to do the treatment. If approval of the CRM, the patient’s physician may make fertilization without risk of being punished.

If there is no consent, the patient can still go to court, says Amaral. “We live in a democracy, the ideas are there to be discussed,” he added, noting, however, that in any way, the demand for assisted reproduction for women over 50 years is very low, probably less than 1%.

Physicians working with assisted reproduction in Brazil consider the rules of the CFM a good text, but what is the maximum age of 50 years for the patients.

“I think this rule that out is extremely good. It in no way affects the honest work that clinics do today “, said Luiz Fernando Dale, an expert in human reproduction Dale Clinic in Rio de Janeiro. “If we’re going to do a review, perhaps the only one I would question is the 50 years,” he adds.

“If the trader thinks that woman is 50-something health for this, I do not see why restrict” he says.
The doctor Orlando Castro Neto, who in October saw the birth of a woman of 61 years of Santos (SP), gave a similar assessment . “I agree with this determination, but also agree that there has to be common sense. Needs to be evaluated the clinical status of the patient and gynecological. This is more important than the age factor, “opines.

The limit of 50 years is a measure unusual world, admits Adelino Amaral. Even Italy, where regulation is considered one of the strictest in the world, does not impose age limits for patients.

In Japan, a recent study by the Ministry of Health, Labour and Welfare suggested that some action is taken accordingly. In addition to the higher risk for pregnant women older group also pointed to the chance of successful treatment – a problem that affects the public coffers, since the government helps in assisted reproduction.

The United States has considered lenient regulations for assisted reproduction. There are slight variations between the states, but, roughly speaking, there are no restrictions nor age nor the marketing of gametes or leasing bellies. “There can everything but can not clone, by federal law,” said Adelino Amaral.

European countries are, in general, they impose more restrictions on assisted reproduction. Italy, Germany and France have laws specific to the practice, while the UK has a government agency that regulates the industry.

The Spanish legislation is considered the mildest, and the country to receive visitors from other parts of the continent seeking access to the so-called “birthers” – unlike most, Spain did not prevent the commercial use of the practice in which a woman generates in her womb the embryo that was fertilized the egg of another woman, who is considered the true mother.

The Brazilian standard is closer to the more rigorous texts, with similar prohibitions in that restricted the sale of gametes and genetic selection of babies. However, the CFM resolution has no force of law, and the maximum punishment would be revocation of the license of doctors – in Germany and Italy, who breaks the rules can even be arrested.

“The rules of the board is enough to allow parliamentarians to care about anything else,” says Luiz Fernando Dale. For him, the discussion must remain within the scope of the medical profession to prevent external aspects of the profession are taken into account. “There is no law to stifle leg” compared.
